The Englewood Cliffs, New Jersey-based direct private lender recently announced the closing of a $3 million loan to Lost Lagoon Development for the acquisition of 101.46 acres of land at 17512 Toledo Blade Boulevard in Port Charlotte.
Lost Lagoon Development purchased the property for $3.755 million, and Kennedy Funding closed the loan, at 80% of the purchase price.
“A commercial real estate loan at 80% loan-to-cost, particularly on raw land, is quite rare in the hard money space,” said Kevin Wolfer, CEO, Kennedy Funding. “Knowing the contract contained several contingencies for rezoning and site plan approvals significantly increased this property’s value and made this an extremely unusual and attractive arrangement. Once the borrower secured the approvals, we were able to quickly close.”
Originally part of a 1,100-acre tract purchased by Charlotte County in the early 2000s, the area was slotted for a mostly residential development called Murdock Village. The Great Recession of 2008 derailed those plans and left the area vacant for nearly 15 years. The county has since sold off parcels to private developers, including 450 acres for a 2,400-home residential community.

Central to Arredondo Pointe is a Lost Lagoon-branded hotel and 45-acre water park.
“For many years, Port Charlotte officials have envisioned a thriving downtown in this area,” Mr. Wolfer said. “Now, with the capital to start, the construction process can finally begin.”
The first phase of construction calls for building a hotel and retail space on the southwest corner of the property, with the water park coming in the second phase and the town center in the third phase. Lost Lagoon will also make infrastructure improvements around the property, including sidewalk installation, landscaping, and water and sewer lines.
“Arredondo Pointe will be a destination for both Port Charlotte and all of Charlotte County,” Mr. Wolfer said. “Port Charlotte has been ready for new commerce and development for quite some time, and with the borrower’s guidance and expertise, this vision will finally come to fruition,” and noted that Arredondo Pointe is expected to create 500 to 800 non-seasonal jobs for area residents.
Obtaining funding has been made extraordinarily difficult during the COVID-19 pandemic, he added, and the already limited appetite for raw land has been completely evaporated.
“Traditional lenders will not even consider lending on raw land, especially now,” Mr. Wolfer said. “As a private lender, we were able to circumvent those typical barriers to funding, and examine the merits of this deal. In this case, the borrower has a clear plan with all approvals in place. It was easy for us to share in Lost Lagoon Development’s vision for the future Arredondo Pointe.” ¦

Reputed Philadelphia Mafia boss Joseph (Skinny Joey) Merlino and his racketeering co-defendant Anthony Cirillo were approved to attend the Sunday nuptials in Florida — just not at the same time.
Mobster Merlino is standing as best man for groom Michael Caudo, and leaving the event once the couple declares "I do." Cirillo was ordered to skip the wedding and appear only at the subsequent reception.
Both were admonished to do so without discussing the bridesmaids' dresses, the choice of entrees or any other topic.
"Defendant Merlino shall attend only the wedding ceremony on (Sunday) and not the reception," wrote Manhattan Federal Court Judge Richard Sullivan in his Thursday ruling.
"Defendants Merlino and Cirillo shall not speak to each other or otherwise communicate with each other."
Merlino also received the go-ahead to attend Saturday night's rehearsal dinner when Sullivan extended his court-imposed curfew by three hours to 10 p.m. Merlino — currently out on $5 million bond after his August 2016 arrest as part of a massive mob crackdown — is typically confined to his home between 7 p.m. and 7 a.m.
Sullivan agreed to let Merlino attend the Saturday dinner at the Boca Raton Resort & Club. The event starts at 6:30 p.m., making Merlino a likely no-show if the curfew was enforced.
The Sunday wedding posed a different problem.
Under the terms of their release pending trial, the 55-year-old Merlino and alleged Gambino family associate Cirillo, 51, of Englewood Cliffs, N.J., are barred from contact.
Merlino's lawyer Edward Jacobs first proposed the Solomonic solution of cutting the wedding in half.
"Mr. Merlino will attend the wedding ceremony ONLY, which is scheduled to begin at 9:30 a.m.," suggested Jacobs in a letter to the judge. "Mr. Merlino will then leave immediately following the wedding ceremony in order to allow Mr. Cirillo to attend the remaining reception/luncheon."
Sullivan showed some love to both defendants and signed off on the deal, with his "no contact" caveat.
Merlino, a convicted felon, was arrested in Florida last August for conspiring with members of the city's Genovese, Gambino, Lucchese and Bonanno families in a wide-ranging racketeering operation.

"We are hoping to get her attention and bring it home," said lead attorney Rebecca Parsons Schram, who was seeking damages of more than $15,000 on behalf of her clients.
Vaknin has a business model of renting dilapidated apartments at 6040 NW 12th Ave., in Miami, to poor families and refusing to make repairs, the lawsuit said. The City of Miami declared the building unsafe and filed a lawsuit against the property owner Oct. 29, 2014 due to numerous code violations.

Schram said that when Daniels, a resident at the property from May to August of last year, talks about "being comfortable," she is referring to "uninterrupted utilities, structurally sound buildings" and plumbing repairs. Daniels also reported raw sewage raining down from her ceiling.
Chatfield lived in the property with her five-year-old daughter from May to December of last year. The ceiling, which she had complained had been leaking water, fell on her daughter on June and August of last year. And Chatfield was hospitalized for five days after a black widow spider bit her, according to the lawsuit.

Williams has lived there with her son since November 2012, the lawsuit said. Williams said she had a holes, water damage and mold on the walls and damaged electrical wires. She organized a "rent strike" and received four eviction actions.
The Local 10 News' three-part "Call Christina" investigation "Left To Rot" reported on the on-going issues that the residents at the apartment units faced. The long list of issues also included mold, ceiling cave-ins and sewage leaks.
"The message is you are going to be held personally accountable … you are not going to get away with this any longer," Schram said. "You have got to take care of these apartments; you have to protect these tenants from the ceiling falling down."
The goal is that landlords be forced to maintain basic standards, and when they choose no to maintain those standards that they be held accountable. Schram said the families want to hold Vaknin personally accountable for the deplorable conditions of the apartments.
"The problem is she [Vaknin] has been hiding through these shell corporations," Schram said referring to corporations without assets or operations. The "fear is that you are going to get judgments against these corporations and they are going to be just that, judgments on a piece of paper."
The property at 6040 NW 12th Ave. is one of nine Miami apartment buildings owned by companies that state records show all go back to Vaknin at 99 Roberts Road, Englewood Cliffs, in New Jersey.
Vaknin purchased the property through Miami Beverly July 14, 2009. The Florida Department of State dissolved Miami Beverly Dec. 19, 2011 and reinstated it March 6, 2012. Miami Beverly quit-claimed the property to both Freedom Apartments and Liberty Apartments on Feb. 11, 2015.
When Local 10 News Investigative Reporter Christina Vazquez met Vaknin at the multimillion dollar home in New Jersey, she and her husband, Abraham Vaknin, dodged questions.
Corporate entities are usually formed to protect individual corporate members for acts committed by the corporation. As a result of the tenants' lawsuit, Vaknin will have a greater incentive to defend herself. Their property is facing 10 liens from the city.
Former state and federal prosecutor David Weinstein, who is not involved in either of the lawsuits, said that since the tenants' lawsuit names Vaknin, and not just the companies she runs, they may be able to go after her personal assets to satisfy any monetary award they receive.
