NORTH MIAMI BEACH, FLA. (WSVN) - Tuesday night’s commission meeting had some questioning if North Miami Beach’s mayor Anthony DeFillipo is even their mayor at all, but he is calling this nothing more than a political witch hunt.
“Sir, you’re out of order. Mr. Attorney, you are out of order,” said DeFillipo.
It was a disorderly meeting and a storm-out session, Tuesday, as city attorney Hans Ottinot got up and out, refusing to recognize DeFillipo as the mayor.
“I have been and always will be a resident of North Miami Beach,” said DeFillipo.
A pair of city commissioners called for an investigation into whether DeFillipo actually lives in North Miami Beach, which is required for him to sit as mayor.
Those commissioners said the legal opinion of a law firm brought on to investigate believes DeFillipo does not.
The commissioners are alleging the mayor lives elsewhere.
“They’ve had plenty of opportunity to do what’s required under the law. Go to court and bring it in front of a judge, they know that and instead of doing that we’ve got this well orchestrated circus,” said Michael Pizzi, who is the mayor’s attorney.
With only three commissioners present Tuesday, it meant no city business could get done, and so the public opinion portion was mostly focused on the dysfunction of their city.
“I don’t think they should be able to keep their seat, and I want every resident and every person in this room to think about that,” said a resident.
“When you don’t have rule of law, that’s when a city and a municipality and a country goes down,” said a man.
When asked by 7News if he is living in the city of North Miami Beach, DeFillipo responded, “Yes, I am I am a bonafide resident of the city of North Miami Beach.”
7News asked where he believes they get this assertion. He responded with, “I’m an investor. I invest in properties. I buy and sell properties, and so they are assuming that I live in a property which I don’t. I live here in North Miami Beach. I always have.”

The former home of Laurenzo’s Italian Market in North Miami Beach could be redeveloped into a mixed-use project with three towers.
May NMB LLC, an affiliate of Lakewood, New Jersey-based Accurate Builders, filed a municipal pre-application with Miami-Dade County concerning the 3.03-acre site at 16445 and 16385 W. Dixie Highway, plus 2255 N.E. 164th St. The site currently has 52,120 square feet of commercial space, mostly the old market.
Laurenzo’s Italian Market closed in 2019 after 69 years in business. Laurenzo’s Italian Center, Laurenzo Brothers Property and 2255 Land Associates have agreed to sell the property to May NMB LLC.
The project would total 2.08 million square feet with three towers of 34 stories each connected by a parking podium. The building would extend over Northeast 164th Street, so cars could drive underneath the structure.
It would feature 1,217 residential units, 23,279 square feet of commercial space and 1,622 parking spaces, include 36 electric vehicle chargers. The amenity deck on the ninth floor would have three lawn areas, two pools, a spa, a pet run and a playground.
The project would have 171 studio apartments, 538 one-bedroom units, 109 one-bedroom units, with dens, 252 two-bedroom units, 74 two-bedroom units with dens, and 73 three-bedroom units.
The application describes the project as being developed in three phases, starting with 449 apartments, 18,476 square feet of commercial space and 1,192 parking spaces. The second phase would be 419 units. The final phase would consist of 349 units, 4,803 square feet of commercial space and the rest of the parking spaces.
The project would require the realignment of several streets, including Northeast 22nd Avenue, and the creation of a westbound left turn lane.
Miami-based attorney Matthew Amster, who represents the developer in the application, couldn’t be reached for comment. Miami-based RSP Architects designed the project.
“The thoughtfully designed podium and towers offer a desirable mix of uses and open space that will create pedestrian-oriented spaces where people can live, work and play,” the developer stated in the application. “The proposed development will contribute to the creation of a modern urban downtown area, synergizing with other nearby and future developments.”
This project would also require approval from the North Miami Beach City Commission.
There’s been a wave of redevelopment in North Miami Beach after the city increased density several years ago. In fact, BH Group has proposed a 32-story apartment tower on a neighboring site.

The waters are warm and turquoise with soft sand - just perfect for flopping on the beach and getting a tan. The beaches are typically well-staffed with lifeguards and rival the beaches of California.
South Beach on the southern tip of the barrier island of Miami Beach is the most famous, but the quieter strands of Mid-Beach and North Beach are also stunning with a more low-key vibe. They have more space for one to spread out a towel and get a tan. Further to the north is Haulover Beach which has the distinction of being the oldest officially recognized nudist beach in the state.
Miami also has a number of dog-friendly beaches - including South Beach’s South Pointe Park and breezy Hobie Island Beach Park along the Rickenbacker Causeway. Here people can take the leash off and lead the doggies to enjoy the surf.

North Miami Beach commissioners voted to fire City Manager Arthur H. Sorey III Tuesday evening, days after the city attorney resigned amid ongoing tension over questions about Mayor Anthony DeFillipo’s residency.
Commissioners voted 6-1 to fire Sorey without cause, with DeFillipo being the lone no vote. On a previous vote that evening, the mayor voted to fire Sorey with cause, which would have prevented him from receiving 20 weeks severance pay. It was the first meeting in five months with a quorum with all commissioners attending in compliance with a judge’s order.
Sorey fielded questions from commissioners about spending and was criticized for purported unprofessional behavior toward staff, a claim he denied, before he was fired and asked to leave.
“This is all about competency and nothing but that,” DeFillipo said before the commission made its decision. “It is time that the water settles in North Miami Beach and I hope that today is that day.”

Calls to fire Sorey and former city attorney Hans Ottinot were initially made during a December commission meeting, in which Commissioner McKenzie Fleurimond walked off the dais before a vote could be taken.
Since then, the city has been operating without a full commission after three commissioners — Fleurimond, Daniela Jean and Michael Joseph — declined to attend the meetings over allegations that DeFillipo lives elsewhere and should not be mayor. Earlier this month, a Miami-Dade Circuit Court judge ordered all of the commissioners to attend the March meeting.

Commissioner Phyllis Smith raised concerns about spending in the procurement and finance department, allegations that Sorey interfered in the last city election, and what she described as “filthy language” and “bullying” of employees.
She also called for a forensic audit of every department to see how the city spent money. “I need to see how your tax dollars are spent,” she said.
Sorey denied claims of unprofessionalism and called some of the comments about him “mudslinging.”
“To call into question my character, some of the comments made were very sickening,” he said before thanking residents and a few of the commissioners for their professionalism.

Commissioners unanimously appointed Mark Antonio as city manager. Antonio previously had served as city manager for Hallandale Beach for two-and-a-half years and worked for that city for 25 years.
“I’m honored and humbled by this opportunity,” Antonio said. Antonio was set to have a quasi-judicial hearing regarding an awning added to his home.
Antonio said he wants to carry out the city’s vision and assess its financial health.
“I love our city. I’m blessed to be here at this point in time,” he said, with a crack in his voice. “I’m sorry to get a little emotional, but it’s a difficult time for our city. It really is.”
The commission also voted unanimously to hire John R. Herin Jr. as interim city attorney. Herin is a partner at Fox Rothschild LLP and previously served as city attorney for several South Florida cities including Marathon, Doral and Tamarac. Commissioner Jay Chernoff was also voted vice mayor at the meeting.
The ongoing feud between the mayor and commissioners was on full display Tuesday evening over allegations that DeFillipo does not meet residency requirements and that Joseph has not attended meetings for 120 days in violation of the city charter.
“I don’t feel comfortable sitting up here with someone who has violated the charter over 120 days,” DeFillipo said.
Commissioner Jay Chernoff has filed a lawsuit saying his colleagues Joseph and Fleurimond violated the city charter because they missed meetings when they were protesting the mayor’s residency.

Fleurimond criticized DeFillipo for turning the meeting into a political show and said the issues should be handled by the courts. “I believe this is not the appropriate venue to hear this issue,” Fleurimond said, adding that the mayor insisted on having concerns about his residency be handled in court. “If it’s good for you, it should be good for everyone else.”
Fleurimond and Joseph refused to leave the dais while their colleagues discussed the litigation involving them, a potential violation of Florida’s conflict of interest statute. No vote was taken on whether to remove Joseph from the commission.
The commission briefly discussed DeFillipo’s residency without the mayor present. Fleurimond again said it should be handled by the court. “I believe that we have a responsibility to allow a judge to do that,” he said.
A hearing on the vacancy issue will be held March 28. The next hearing on the matter of DeFillipo’s residency will be held April 27.
