A judge has dismissed a lawsuit filed by a South Florida woman against the Kraft Heinz Food Company over the time it takes to make its Velveeta microwavable mac and cheese.
The class-action complaint was filed in November in the Southern District of Florida Miami Division on behalf of Amanda Ramirez, of Hialeah, and said the box's claims of "ready in 3-and-a-half minutes" doesn't accurately portray how long it takes to prepare the meal.
The suit alleged that the Pittsburgh-based company sells more of the product, and at a higher price, by misleading consumer's about the Velveeta Shells & Cheese prep time.
In a July 27 ruling, U.S. District Judge Beth Bloom granted Kraft's motion to dismiss the lawsuit, saying Ramirez didn't suffer an injury and continued to purchase the product after learning the label was allegedly "deceptive."
"She does not allege that she was unable to consume the product or that it was otherwise so flawed as to be rendered useless," Bloom wrote in the 13-page ruling. "In fact, the Complaint does not even include an allegation that Plaintiff ever attempted to cook the product."
The lawsuit had been seeking more than $5 million in damages and class-action status covering consumers in Florida, Alabama, Georgia, North Carolina, South Carolina, Utah, New Mexico, Alaska, Iowa, Tennessee and Virginia.
"There is no real and immediate threat of future injury. Plaintiff’s counsel conceded that point during oral argument and acknowledged that Plaintiff lacks standing to seek injunctive relief," Bloom wrote. "The Court agrees that Plaintiff lacks standing to pursue a claim for injunctive relief."
Ramirez found the statement on the box that it would be ready in 3½ minutes "false and misleading" because in the directions, only one of several steps takes that amount of time, according to the suit.
"Consumers seeing 'ready in 3½ minutes' will believe it represents the total amount of time it takes to prepare the Product, meaning from the moment it is unopened to the moment it is ready for consumption," the suit said. "However, the directions outlined above show that 3-and-a-half minutes is just the length of time to complete one of several steps."
In a statement after the suit was filed, Ramirez's attorney, Will Wright, said corporations shouldn't get a pass for "deceptive advertising."
"I’ve gotten a lot of flak about this case, but deceptive advertising is deceptive advertising. Here, Kraft charges extra for a desirable feature (saving time) but the marketing is false, it takes far longer for the product to be ready than as advertised. Deceptive adverting plain and simple," his statement read. "There are a lot of people that may feel this is just a little fibbing and not really a case and I get that. But we are striving for something better. We want corporate America to be straightforward and truthful in advertising their products."
Kraft had previously called the lawsuit "frivolous."

That gives Jaramillo’s company ownership of about 3.65 acres of land. The city recently changed the land use on the property to transit-oriented development (TOD).
The site is located two blocks northwest of the Tri-Rail/Metrorail Transfer Station.
Jaramillo said he’s working with Miami-based Modis Architects on the redevelopment. His plan calls for 612 apartments in two buildings of 10 stories each, along with 4,000 square feet of retail and a parking garage. There would be an interior courtyard with a pool, and two other courtyards. Amenities would include a 3,000-square-foot fitness center.
Jaramillo said he worked through an intermediary starting in fall 2022 to contact each homeowner and offer them a price higher than their homes were worth.
“Hialeah is where much of the Cuban population first came to Miami-Dade during the 1960s and most of these owners had their homes since the 1970s with no mortgage on it,” he said. “Everybody agreed to a higher price than their home was really worth.”
There’s been an influx of development near the Metrorail stations in Hialeah recently as people seek less expensive apartments within walking distance of public transit. MG Developer has a $600 million project coming to that area.

Seritage Growth Properties shed another South Florida Sears site, selling a shuttered store in Hialeah to Codina Partners.
Codina, led by the father-daughter team of Armando Codina and Ana-Marie Codina Barlick, paid $16.5 million for the 153,596-square-foot big box store at 1625 West 49th Street, according to a source familiar with the off-market deal.
The building is attached to Westland Mall, an indoor shopping center owned by Dallas-based Centennial. The deal also includes an outparcel that was previously a Sears automotive center and an adjoining parking lot.
In 2020, Seritage closed the department store and automotive center, which were both completed in 1980 and sit on 15 acres, records show.
Codina is partnering with Centennial, James Carr and Manny Kadre to redevelop the Sears site into a mixed-use project with an apartment component, according to a press release.
We are very early in the planning stages, but would love to provide primarily residential with additional retail subject to Centennial’s approval,” Armando Codina said in a statement. “Commercial is also a possibility. The goal is for this project to be as transformational for Hialeah as Downtown Doral has been for the city of Doral.”

Centennial, led by Steven Levin, acquired Westland Mall last year from Barry Sternlicht’s Starwood Capital Group by assuming a $149.4 million mortgage.
The shopping center’s anchor tenants are Macy’s and JCPenney, but both buildings are owned by other entities. Retailers at Westland Mall include Bath & Body Works, Pandora, and Express Factory Outlet.
Seritage, a New York-based Sears real estate spinoff led by CEO Andrea Olshan, has been offloading properties for the past year. It’s part of a strategy to pay down $640 million in mortgage debt owed to Warren Buffett’s Berkshire Hathaway.
Last year, Seritage sold a former Sears site at Southland Mall in Cutler Bay to North Palm Beach-based Electra America and Aventura-based BH Group for $34 million. Also last year, Seritage sold an Aldi-anchored retail plaza near North Miami for $38 million to Raanan Katz’s RK Centers.
Seritage is also finishing construction of Esplande at Aventura, an office and retail project on the site of a former Sears store at Aventura Mall, according to the company’s first quarter earnings report.

Project on former Salvation Army site is expected to be completed by year-end
Prestige Companies and its partner scored a $20.5 million construction loan for a multifamily project on a former Salvation Army site in Hialeah, marking the firm’s continued wager on the city.
Prestige and Florida Value Partners have started building the project, consisting of 100 townhouses for rent and a three-story building with 12 apartments atop 5,000 square feet of retail, said Prestige’s Alexander Ruiz. The project, at 7450 West Fourth Avenue, is expected to be completed by year-end.
The lender is Amzak Capital Management, the Boca Raton-based private investment firm for the Kazma family, records show. The Kazmas, who hail from Canada, built a cable television empire in North America and Latin America before focusing on investments in real estate, fixed-income assets such as corporate bonds, health care and industrial companies, according to Amzak’s website. Gerry Kazma is chairman, and his son, Michael Kazma, is president.
An affiliate of Prestige originally bought the nearly 5-acre development site in late 2021 for $8.3 million, a deed shows. Last year, that entity sold the property to a partnership of Prestige and Florida Value for $15 million.
The site is an Opportunity Zone, areas deemed in need of an economic boost. Investors can defer capital gains taxes by putting their money in a qualified Opportunity Zone fund, which in turn bankrolls real estate and business projects on Opportunity Zones.
More than $15 million in Opportunity Zone capital is earmarked for the Hialeah project from a qualified fund, which includes capital gains from Prestige and Florida Value, Ruiz said.
The developers scored city approval of the project last March.
This is the latest Hialeah project by Prestige, a Miami Lakes-based firm led by CEO Marty Caparros. The firm has built several Amelia-branded communities, named after Amelia Earhart, who attempted to become the first woman pilot to fly across the globe but disappeared in the Pacific Ocean.
Las Vistas at Amelia consists of 174 apartments at 7925 West 2nd Court. The Amelia mixed-use district has 30 rental units and two commercial units totaling 17,000 square feet.
Last year, Prestige also made headway in its plan to develop a 343-unit apartment complex and a charter school on an unused portion of the historic Hialeah Park Racing & Casino. Prestige paid $13.1 million for the 13-acre development site at the park, which no longer holds live races but has state approval for slot machines, card games and pari-mutuel wagering on televised horse races.
Florida Value, a Miami-based firm led by managing partner Gus Alfonso, has a portfolio of more than $1 billion of assets under management amassed since the firm was founded in 2008, according to its LinkedIn.
Hialeah, traditionally a single-family home community with an industrial real estate supply, has caught multifamily developers’ interest in recent years.
The Pérez family’s Related Group and Jeffrey Soffer’s Fontainebleau Development are developing a 642-unit complex at 7218 West Fourth Avenue, a former track for the now banned practice of greyhound racing, according to media reports.
Also in Hialeah, Dacar Management is building a 244-unit multifamily complex with retail at 3685 West 85th Path.
