NEWTON − The Town Council approved three ordinances establishing a town budget for this year, as well as capital budgets for general town projects and one for the sewer and water department projects.

While Town Manager Thomas S. Russo's budget message sounded an initially dour outlook on finances, the general town budget of $16,382,302 contains a town tax increase of just $5 per month. He said the average residential tax bill for Newton taxes will rise from $2,838 paid in 2022, to $2,899 this year.

The budget message, presented at Monday's council meeting, said there has been growth in new developments in Newton and the town's Net Valuation Taxable − the amount of property which actually pays taxes − saw its biggest increase in more than seven years while the average property assessment also rose from the 2022 level of $185,293 to this year's level of $185,638.

Since 2011, the town's annual tax increase has been less than $100 and in 2019, there was no tax increase. From 2004 to 2010, the annual increase was in three figures, topping out at $298 in 2008.

Russo said he and the financial team, headed by Chief Financial Officer Monica B. Miebach, are able to use the last year's budget surplus to keep the tax rate down. In 2021 there was a fund balance of $2,922,773 of which $1,425,200 was used in the 2022 budget. The 2022 budget ended with a $3,778,446 surplus of which $2,050,791 was factored into this year's spending package. The remaining $1,727,655 is available to be used, if needed, in this year's budget as well.

The amount of state aid, as a percentage of the town's total budget, will be just 6.61% in 2023, continuing the decline in each year from the 8.18% of 2017. Total state aid will be slightly more as a dollar amount this year at $1,086,018, compared with $1,025,916 from Trenton last year, however.

As with most municipal budgets, salaries, wages and benefits, totaling nearly $9.5 million, constitute 58% of this budget. In 2022, employee costs were more than 62% of the budget.

Capital projects in Newton

Capital projects, paid directly from the budget and through bonding, will amount to $5.4 million in 2023, led by $2 million in renovations and repairs at Fire Station #1 on Mill Street, $140,000 for upgrades to the roller hockey rink in Memory Park and $76,000 toward repairs and upgrades to the "kiddie pool" at the municipal pool complex, also in Memory Park.

In addition to purchase of equipment, such as dump trucks, the capital projects fund also plans to use $515,000 for sidewalks on Swartswood Road, $375,000 in the emergency dispatch center, and $825,000 for a boardwalk between Memory Park and the state-owned rail-to-trail on the other side of the marsh which borders the park.

Those last three projects also include federal, state and private grants.

The capital projects budget also includes $265,000 for a reassessment project which was approved by the council in separate action Monday.

Because there was a lag in doing reassessments within town, the equalization rate for Newton properties went beyond a number which triggers possible state action. In response, the council decided to hire an assessment contractor to do annual updates to property values.

Appraisal Systems of Morristown, was awarded a five-year contract for $265,000 to do the annual updates, beginning with $125,000 worth of work beginning Oct. 1, and $35,000 for each of the following years.

By doing continuing reassessments - looking at and updating assessment records each year - it is hoped that changes in property values will remain in line with current conditions. The equalization rate, set by the state and county Board of Taxation, is a mathematical formula meant to take into account municipal records which may be lagging or out-of-date, to "equalize" tax rates across varying taxing districts.

Newton water and sewer budget

The council also approved the 2023 water and sewer district budget, but on a vote on the tax rate going forward, Councilman Jean Paul Couce voted no, without comment.

Part of the discussion when that budget was proposed several weeks ago was that there were built-in increases in fees and no deafferenting between residential and commercial rates.

The town has 2,745 accounts served by the water/sewer system and will operate in 2023 with a $4.95 million budget.

The new rates, which are now in effect, have a residential minimum (up to 4,000 gallons of use per quarter) of $31.50 for each quarter and a sewer rate of $47.25 per quarter, for a combined rate of $78.75 per quarter.

The combined rate per quarter goes to $82.69 in 2024, and $84.76 per quarter in 2025.

The rates also increase for usage of more than 4,000 gallons per quarter.

NEWTON − Under a bright October sun, the Moran Street mural was unveiled on Thursday with a formal dedication ceremony and ribbon-cutting.

The project, which involved a professional muralist working with groups of volunteers, is part of a Neighborhood Preservation Program grant which is sprucing up the town's Spring Street shopping area and has already funded large planters on the sidewalks and a series of speakers which can pipe in music - Sinatra played Thursday afternoon - as well as carry narration of the several parades the town or other organizations sponsor each year.

"There's still much more we are looking at," said Town Manager Thomas S. Russo, after the ribbon-cutting which attracted some of the more than 100 volunteers who helped paint the mural in sections under the direction of Caren Olmsted, of Olmsted Mural Group.

In addition to the public places getting upgrades, the Neighborhood Preservation Program also provides grants and low-interest loans to property owners to fix up facades and storefronts along the four-block stretch of Spring Street between Main Street and the Madison- Union Place/Spring Street intersection.

The next public project is rejuvenating an alleyway from Spring Street to one of the surface parking lots with fresh paint and wrought-iron decorations, such as existed decades ago.

Olmsted, a native of Morristown, works on her murals from a studio in Basking Ridge. She came to Newton to work with the volunteers this summer where they painted the mural panels in the Spring Street basement of J. Caldwell and Associates.

Jessica Caldwell is a professional urban planner who works with the town and suggested the mural as part of the overall "preservation project."

Olmstead said she enjoyed the sessions with the public and noted many of the painters had personal recollections of being at scenes depicted on the letters N-E-W-T-O-N which make up the mural.

She told how volunteers picked out sections of the mural to work on and noted: "One woman even exclaimed, 'That's where my husband proposed to me' as she picked out a scene to work on."

In addition to the actual painted mural - painted on the side of 15 Spring St., which gave room for the 60-foot long illustration to be seen - the project includes installation of surveillance cameras overlooking the intersection and warning signs alerting the public the entire mural is under 24-hour watch.

The concept painting is from Caren Olmsted of the Olmsted Mural Group as part of a larger Neighborhood Preservation Program, which includes alleyway improvements with signage and lighting as well as signage and façade improvements on some storefronts on Spring Street.

The town has just finished installation, with the help of Planet Networks, of an outside PA system on Spring Street which can play music for shoppers and is used for narration of events such as parades and the annual Taste of Newton. Last summer, the long-term project brought flower planters to the downtown shopping district.

The August event is tentatively planned for the basement area of the J. Caldwell and Associates building on Spring Stret where the participants will be creating the panels which will make up the finished mural. That process is expected to take place over the course of a week.

Olmsted, a native of Morristown, has her studio in Basking Ridge, and founded the company after spending several years as a set and lighting designer and four years as an art educator. She holds a degree in theater design from Bates College, and has an art education degree from Appalachian State University.

NEWTON - A homeowner whose restoration project collapsed was given permission from a town commission to rebuild a High Street house in the town's historic district.

The project by Angel Pacheco stirred up some controversy since the owner removed the two-story house despite having only permission to begin renovations.

Monday's agenda for the Historic Preservation Advisory Commission noted that Pacheco's appearance was to: "Rebuild structure demolished without prior approval."

While the two-story residence has no historic significance by itself, it is part of the historic district in the center of Newton. He had earlier appeared before the commission and got approval to restore the house.

However, as he explained to the commission, he and a crew were inside the home tearing out old plaster and lath when "the house began creaking and cracking." He said the second floor collapsed, nearly trapping workers inside.

At that point, the house was a total loss because of rotten and insect-riddled wood which he carted off to a landfill, leaving just the foundation.

Before the meeting, commission member Harry Kaplan, who is a school crossing guard at a nearby intersection, confirmed that the wooden structure was rotten. He said his post allowed him to watch the process and speak with Pacheco during the demolition.

For nearly 90 minutes, Pacheco explained how he planned to rebuild the house so that the exterior matched the original and offered up examples of what was saved from the structure, such as decorative wooden adornments, and examples of what the siding, windows and porch railings would be.

In addition to board members, Pacheco also got in a discussion with Wayne McCabe, a High Street neighbor, who is a professional in historic restorations and past Sussex County historian.

As McCabe went down the list of exterior items, the homeowner/contractor agreed to what would go into the reconstruction − wood, plastic or metal. The discussion even came down to an agreement for a "replica chimney" which would be built on the roof to replace the original full brick chimney.

As explained by McCabe, even a plain house is made distinctive by its "windows, doors and chimneys."

While Pacheco wanted to put on a metal roof, replacing what was on the house before it collapsed, McCabe suggested going with modern shingles which appear more like the original slate roof would have been when the house was built in 1806.

"Oh, that will be cheaper," exclaimed Pacheco. "Thank you."

The owner said the foundation is solid for replacing the 928-square-foot house, and he would also recreate the nearly 200 square feet of porches.

While none are yet open, Newton is just months away from having three retail cannabis retail stores, a delivery service and a manufacturing plant.

On Monday, the Town Council approved Curiosity Cannabis to open a retail operation at 70-72 Mill St., which would be next door to another retail store 78 Mill St., and across the street from where a manufacturing business also has plans before town and state approving agencies.

Town Manager Tom Russo said those three are in addition to the former carpet store at 117 Water St., which was approved by the council and planning board early last fall. That company, Newton CB, LLC, is owned by the Romano family which owns Shoprite stores.

Part of the state's licensing process requires applicants to have municipal approvals before a license is granted. Those licenses fall in different classes: growing, manufacturing, storing, delivery and retail sales.

According to Russo, the Water Street store apparently has all the necessary permits and licenses and just needs to renovate the building.

This latest applicant is applying for two state licenses − retail and delivery, according to Russo. The business is owned by Nicole Hughes, of Chicago, who has a 60% ownership. Perry Maio of Sparta, who owns the property at 70-72 Mill St., is listed as a 35% owner. The remaining 5% owner is listed as Rabbi Shmaya Krinsky of Hillsboro.

The application from New Re-Leaf, which seeks to put a retail store at 78 Mill St., goes before the Newton Planning Board at an April 19 meeting.

Russo said the proposal for the manufacturing facility will go before the Planning Board's Technical Review Committee which meets next week. That committee serves as a first-step in the process to look for and discuss potential issues prior to going before the full board.

As allowed by state law, Newton has established a tax on the various types of cannabis operations based on how much business they do. The tax was established in 2021, before any applications were made and has not yet produced any revenue for the town.

The town's 2023 budget, approved at Monday's meeting, does not include a line item for cannabis tax revenue.

The council has approved local ordinances which restrict cannabis retail shops to parts of Mill and Water streets. Other cannabis operations are allowed in other parts of town, provided the operation meets zoning requirements.

The council action was to formalize that the proposed business complies with town zoning and other ordinances and that the council supports issuing the state license.
