OAKLAND — Council members voted to approve a cannabis cultivation facility on Muller Road, but then debated a possible November referendum question to see if residents want such businesses in the borough.

The council adopted three ordinances in December 2021 establishing five categories of non-retail cannabis businesses that may be set up in the borough. Kusala Care Cannabis LLC filed an application eight months later, in August 2022, to open a cannabis cultivation facility on Muller Road and filed a $6.8 million tort claim against the borough last December after the borough failed to act on that application.

Wednesday's vote was greeted with applause from residents who have attended several meetings offering support and urging approval. Councilmen Pat Pignatelli, Kevin Slasinski and Russell Talamini voted yes, Councilmen Steven Saliani and Eric Kulmala were absent, and Councilman John McCann abstained.

Borough Attorney Matthew Gilson said a "twofold process" is next, and that "the idea they are going to start growing tomorrow is not accurate."

"There's the statewide licensing requirement, which the applicant will have to go through, and there's the Planning Board process," Gilson said. "The applicant will present a site plan. At that point they will have to present more information on odor control. All these things will be analyzed by the Planning Board engineer and planner. They will have to provide information on traffic, parking."

After the meeting, Kusala Care COO George Lutfey said the company will be applying for a state license next.

McCann has led a relentless campaign against the ordinances since he was appointed to the council in June 2022. He has insisted that even though 62% of Oakland voters approved the legalization of adult recreational marijuana in a November 2020 statewide referendum, it does not mean they want the businesses to operate locally.

Citing a variety of health risks, McCann has repeatedly announced he would not approve any cannabis application regardless of its legality and has championed a motion to repeal the borough's three ordinances designating four zones in which cannabis businesses could operate.

Other council members have been more muted or silent on the topic. Kulmala and Pignatelli have focused on difficulties arising for municipalities because of shifting state regulations on emerging businesses.

A motion to repeal the ordinances has been tabled, but the debate has continued over several council meetings. More recently, the council has shifted to wording for a possible November non-binding referendum seeking voter input on the question.

A draft resolution proposing the referendum posted with the April 12 agenda suggested its wording as: "Do you support allowing businesses to operate in the Borough of Oakland for cultivation, manufacturing and distribution of cannabis as defined by New Jersey state statute?"

The problem is that the wording includes only three of the five approved categories. The question was raised whether wholesaler and delivery categories should be added to the wording. Mayor Linda Schwager also questioned whether retail sales should be added, but was advised that because it was not part of the original ordinances, it would have to be the subject of a separate question.

The council agreed that more discussion was needed on wording, with a county deadline 80 days before the November election.

Millburn ace Steven Echavarria, a third-round selection during the 2023 MLB Draft by the Oakland Athletics, is going to begin his professional career.

Echavarria — the 2023 NJ.com Pitcher of the Year and a First-Team All-State selection — signed a $3 million deal with the Athletics on Monday, according to MLB.com’s Jim Callis.

Echavarria was selected with the 72nd overall pick last Monday, and the deal he agreed to is worth almost three times the slot value of the pick, which was estimated to be worth $1,005,700.

It’s the biggest overslot deal signed so far this year, according to Callis.

Echavarria told NJ Advance Media he was leaning on signing with Oakland after he was drafted. He was a University of Florida commit but will now embark on his professional career after agreeing to the deal.

He tweeted out a photo of him after signing his contract with the Athletics saying “Officially an Athletic!”

The 6-foot-1, 195-pound right-hander had a breakout senior season at Millburn.

Echavarria went 8-1 on the mound with 80 strikeouts and a 0.28 ERA in 50 innings, helping Millburn win the Greater Newark Tournament and the North 2, Group 3 sectional championship. His fastball has been clocked as high as 98 mph, and he consistently sat in the mid-90s with his heater.

He combined his overpowering fastball with a devastating breaking ball, which baffled hitters all spring.

“I’m just excited and happy that it happened,” Echavarria told NJ Advance Media after he was drafted. “So I just gotta get to work now. This is just one step in the process. I still have a long ways to go, so I’m just gonna take it from here and celebrate now. But after this, it’s time to get to work.”

OAKLAND — A 10-year dispute among 1,645 homeowners about their obligations to a 74-year-old lake association agreement under which their homes were built may finally be decided by vote next month.

Ramapo Mountain Lakes board President Joseph Bove confirmed Wednesday that residents were being notified by email that paper ballots will be mailed shortly, and will decide whether the association will continue to collect fees and oversee the maintenance of its common areas.

A shareholder meeting tentatively scheduled for Nov. 22 will announce the results.

"Guidelines require mail notification take place 14 days prior to the vote," Bove said. "Depending on the vote, we will have two agendas ready, one to dissolve the association, and one to determine how it will continue."

The bucolic private club spread over 700 acres at the borough's center began as a summer-home retreat in 1948, on land formerly known as Edward Page's dairy farm. Owners were stockholders, but the obligations tied to that membership were only filed with the county. They were not included in individual property deeds and were forgotten over time as homes changed hands and were converted for year-round use.

Members had exclusive access to the club's two lakes — Crystal and Mirror — when the complex opened. Friendships begun on the beach were solidified with year-round socializing at the association's clubhouse restaurant, tennis courts and swimming pool, at the intersection of Hiawatha Boulevard and Mountain Lakes Road in the servant quarters of Page's De Tweelingen estate.

It was only after the clubhouse burned to the ground in the 1980s that residents lost touch with one another and their shared obligations. By 2006, the private club was forced to open Crystal Lake Beach Club membership to the paying public when only 60 of the 1,645 households signed up for season passes.

In 2012, the association found itself in need of further financial support and began sending dues notices to member homes based on their proximity to the lakes. However, it took until 2018 for the courts to rule that the residents were indeed members of the association and required to finance their share of the upkeep.

Those who did not pay their dues were subject to liens on their homes.

Dues have increased over time and now stand at $539.43 per year for the 62 homes surrounding Crystal Lake, $131.89 per year for 21 households around Mirror Lake, and $65.94 per year for the remaining residents.

Todd Horn, who has lived on Manito Avenue, 1.7 miles from Crystal Lake, since 2003, says he wants nothing to do with the association as currently configured.

"Liability is my biggest concern," Horn said. "The dues started at $50 a year, but that's not where it's going to end. There is a 36-inch drain pipe that needs fixing. What if someone drowns in the lake? We have senior residents living here on limited incomes."

An additional cause for concern is the proposed 150-unit townhouse/apartment development a mile uphill from Crystal Lake, north of Indian Hills High School. Runoff from the site will enter Pond Brook, which feeds into Crystal Lake. Developers estimate only a 1% increase in runoff, but residents are skeptical.

"To what degree do the developers want to be good stewards of Oakland?" Adam Elkin of Lakeshore Drive asked at the project's September hearing. "If they are building more, they should help offset the burden."

Cindy Holdefehr of Lakeshore Drive is among those who want the current administration to continue and has organized a Save Our Lakes group that wants to keep the present governing structure.

"It is protection for our lakes financially and ecologically," Holdefehr said. "I think if changes are made to the board structure to reflect our varying interests, we can work this out."

Ramapo Mountain Lakes has posted on its website a multi-step process to dissolve the current board and replace it with an Oakland Waterways and Lakes Conservancy. Instead of one overarching board, separate groups would be formed to manage the beach club, with separate homeowner associations for Crystal and Mirror Lake residents.

Save Our Lakes attorney Matthew Earle questioned this proposal in a Sept. 12 letter to Ramapo Mountain Lakes attorney Brian Hannon. He suggested that the state Department of Environmental Protection's Safe Dam Act may not allow the current members to dissolve their responsibility for lake upkeep. He also suggested that a transfer of the board's assets would require a two-thirds majority vote.

"Transfer of the lakes to a shell entity with insufficient resources to maintain the dam for the express purpose of avoiding dam liability would in no way excuse Ramapo Mountain Lakes or its constituent owners from responsibility for the dam," Earle stated.

In response, Hannon told Save Our Lakes the board is willing to listen to a proposal to take title of one or both of the lakes, and how it would be funded.

"The board is in the process of vetting at least one other option at this time but if Save Our Lakes wants to submit a proposal the board feels it prudent to consider same to determine the best course of action moving forward," Hannon said.

OAKLAND, Calif. — The Yankees’ 11-run eruption on Wednesday night against the Athletics didn’t come up once in manager Aaron Boone’s postgame presser.

Obviously not. Domingo Germán had just thrown a perfect game! The right-hander’s historic performance instantly trumped any other trends, narratives or storylines.

The timing was certainly ironic, though. Boone had been peppered with questions surrounding the Yankees’ inept offense — the worst unit in baseball with Aaron Judge on the injured list — for almost four weeks. The Yankees first true breakthrough in almost a month turned out to be a footnote and an afterthought.

On Thursday, in the finale of a three-game series in Oakland, the Yankees made sure their offense received the publicity they deserve. They thrashed the lowly Athletics for a second consecutive game, cruising to a 10-4 win.

Eight of those runs came in the sixth inning for the Yankees, a frame in which 13 hitters came to the plate. That rally began with a booming two-run home run from third baseman Josh Donaldson, a 472-foot missile off the facing of the second deck in left-center field at Oakland Coliseum.

The Yankees were 0-6 in games where Donaldson left the yard entering play on Wednesday, including a 2-1 loss in the first game of this series on Tuesday. Finally, a big fly from the third basaman came in a victory ... a commanding one at that.

After Donaldson went deep, the Yankees poured it on. Chasing left-hander Hogan Harris from the game, the Yankees had seven batters reach in a row with one out. Six of them came in to score.

Giancarlo Stanton’s 108.8-mph double to right field officially broke the game open, plating both DJ LeMahieu and Gleyber Torres to give the Yankees an 8-3 lead. Harrison Bader and Isiah Kiner-Falefa added RBI singles later in the frame against Oakland’s mediocre bullpen.

Perhaps the most remarkable part of Thursday’s outpouring of offense was what it meant for right-hander Clarke Schmidt. The starter earned the win, twirling 5 1/3 innings of three-run ball with three strikeouts.

Schmidt entered play on Wednesday having received nine runs of support in his last six starts combined. The Yankees lost each of those games despite Schmidt’s spectacular 1.97 ERA in that span. Schmidt had 10 runs of support on Thursday.

NOTABLE

-- Anthony Volpe was 2-for-4 with a walk in Thursday’s blowout win. It’s his third multi-hit game in a row. He continues to excel offensively over the last two weeks, a stretch that began after Volpe tweaked his batting stance, closing his front side after watching some old video with former minor-league teammate Austin Wells (while chowing down on chicken parmesan. Volpe is batting .349 (15-for-43) in those 14 games, raising his average on the season from .186 to .213.

-- Donaldson was 3-for-13 in this series against the A’s, hitting two home runs and driving in five runs while striking out six times.

-- Reliever Ian Hamilton made his official return from the injured list, throwing one scoreless inning with one hit allowed.

-- Kiner-Falefa led the team with three runs batted in. He powered his fifth home run of the season to center in the second inning (taking center fielder Esteury Ruiz’s glove over the wall with it), adding another RBI on a sacrifice fly in the fourth.
