SADDLE RIVER — The Borough Council introduced repeals Monday night for two revised ordinances intended to update a proposal to bond and purchase a $1.7 million single-family home on Mill Road.
The revised ordinances were approved by the council on May 8 in response to a complaint filed on April 6 by Concerned Citizens of Mill Road. The neighbors contended that the wording of the original ordinances, approved on March 20, was illegal because it failed to specify that the property would be used as a future affordable housing site.
But the April 6 complaint was dismissed by Superior Court Judge Christine Farrington on May 9. She ruled that the wording of the March 20 ordinances was "adequate in accordance with statutory requirements," even if it did not mention the property's potential use for affordable housing.
Also on May 9, however, a second complaint was filed against the borough on behalf of neighbor Stephen Sweeney of Twin Brooks Road. Attorney Michael Saffer argued that the May 8 revised ordinances which specified the intended use as "affordable housing or other public uses," were also faulty, and that the borough had entangled itself in procedural sequences that would render the purchase illegal.

Borough Attorney David Lafferty notified Farrington on May 12 that repeals for the May 8 ordinances would be introduced Monday, with a public hearing and adoption scheduled for June 12. Lafferty said Monday that the May 8 ordinances would be repealed because the borough is not allowed to have two sets of ordinances applying to the same property. The March 20 ordinances confirmed by Farrington would remain, he said.

Lafferty declined to say what the future of the property would be, only that he expected to meet with borough officials on that question. The borough was scheduled to close on the property on May 5. Lafferty would say only that the borough has not yet done so.

"Despite the repeal of the ordinances adopted May 8, we will pursue vigorous litigation to thwart the opaque and clearly deceptive intentions of the mayor and council," Sweeney said.

The borough is seeking unspecified Green Acre funding for the project, which was the subject of a public hearing late last month. The proposal is posted on the borough's website homepage, saddleriver.org.
"This will increase our parkland by almost 50% and add significant opportunities for passive recreation," Mayor Albert Kurpis said Tuesday. "Residents will enjoy new areas of woodlands along the Saddle River as well as have access to a 3-acre pond. The pond is a beautiful natural breeding ground for many species of waterfowl and is the home of two resident swans."
DEVELOPER SUESDeveloper sues Saddle River over affordable housing denial
The park is south of East Allendale Road between West and East Saddle River roads, accessed via the borough hall parking lot off East Saddle River Road. It is largely hidden from view behind Waterford Gardens, Zion Evangelical Lutheran Church and Borough Hall.
The western parcel would be improved with a trail boardwalk, pollinator gardens, an apiary for beehives, birdhouses and information kiosks. The streambank would be dredged, restored and stabilized while the invasive plants would be replaced with native species.
The plans show the 9-acre portion of the park is designated wetlands in a flood hazard area.
The eastern parcel of the park already contains running and biking trails, a football field, a soccer field, two baseball fields, two tennis courts, an amphitheater, a restroom, a snack stand, a playground and a parking lot.
Council President Rosario Ruffino resigned in protest last July when the cost of the footbridge doubled from its original $700,000 budget. However, a majority of the council sided with Kurpis, who protested at the time that the footbridge has been "part of our master plan for almost 20 years."
Kurpis said the footbridge is scheduled for completion in May. No schedule for the footpaths was included in the Feb. 21 plans.

FAIR LAWN – The greatest Bergen County girls basketball dynasty rolls on.
Sparked by 15 courageous and clutch points from Cristina Parrella, Saddle River Day added to its record with a seventh consecutive Bergen County title by grinding out a gutty 42-37 win over Immaculate Heart Academy on Wednesday night at Fair Lawn High School.
“It means everything,” said Parrella, who scored seven straight points during a game-changing stretch bridging the third and fourth quarters. “This is what I came here for. We win championships. We work hard and it paid off.”
The big storyline coming in was whether IHA could finally beat the Rebels after three straight losses in the Bergen County final. The answer was… they got as close as they ever have.

IHA led 30-28 after a 3-pointer by Julia Schutz midway through the third quarter but then went cold from the floor, failing to score for more than nine minutes.
That break gave Saddle River Day just enough time to surge ahead. Parrella, a transfer from Demarest, sank a 3-pointer, made a jumper from the elbow, then drove to the basket for two more to boost the Rebels to a 35-30 lead with 4:27 left.
“She had a monster game,” Saddle River Day coach Frank Clark said. “She really gutted through after getting banged up the other day. I am really proud of the whole team, everyone. Our team effort was great.”
IHA hurt Saddle River Day with its size inside, but the Rebels were able to clamp down in the final 12 minutes to prevail.
“We knew they were going to fight,” Parrella said. “But we knew we had to fight back and that’s exactly what we did.”
“IHA is a hell of a team,” Clark said. “Isabella Asencio is a great player. What a handful.”
The other main storyline coming in was Clark. He took over the Rebels midway through the county tournament, stepping in for Derek Amalbert. While the school has now won seven county titles, it was the first with Clark on the bench.
“If you had told me this three, four weeks ago, I wouldn’t have believed you,” Clark said. “I am not going to lie, going into this tournament there is a lot of pressure to keep it going, especially filling in as an interim position and having to do this.”
When asked if he would come back and coach the Rebels next season if asked, Clark said “absolutely, 100 percent.”
The bad news for the rest of Bergen County is that the Rebels only graduate one player, senior forward Jess Carter. Parrella is a junior and her running mate at guard, Julianna Almeida (11 points on Wednesday night), is also a junior. Throw in sweet-shooting sophomore guard Faith Williamson and its quite a core of talent for the Rebels.
Now focus shifts to the state tournament. IHA will be a contender in Non-Public A, but Shore Conference titan St. John Vianney may have one of its best teams ever – and that’s saying something. Non-Public B is stacked. Saddle River Day got the top seed, but may not be the favorite in a section loaded with Morris Catholic, Montclair Immaculate and Gil St. Bernard.
“There will be some great match-ups,” Clark said. “We just have to play our game and keep working on things. It’s not perfect, you know. We’re very happy, but you’re never satisfied. You have to keep that hunger going.”
There was even an imperfect moment for Saddle River Day in the final 10 seconds. The Rebels led 42-36 but were whistled for a technical foul for having six players on the court as the crowd looked on puzzled. IHA converted one free throw, but no more.
“That’s a team mistake right there,” Clark said. “That’s on me. We had five coming in and six were on the floor. I don’t know what happened.”
“It happens,” Parrella said with a laugh. “We just had to put it in the past and we did.”
Six players on a court doesn’t happen often. But the number everyone else will remember is seven.
