MENDHAM, NJ — Backer Farm, a local family-run preserved farm, is coming up against criticism from residents as it seeks to add a brewery operation on their property, with citizens protesting potential environmental and cultural impacts.
Several residents spoke out against the potential development at the township committee meeting last Monday, citing too many uncertainties in the application and plans for many of them to feel comfortable allowing the addition to the community.
Among the many speakers was Frank Pinto, Backer Farm's project manager and spokesperson.
Pinto addressed some of the concerns thrown out by residents, addressing the potential environmental impacts that could arise with the changes to the preserved farmland.
"There are no new buildings proposed as part of the brewery project. It is going to be, basically, a redevelopment and reconstruction of the existing hay barn. There is no activity being proposed within the wetlands... Not even any of the buffers are being impacted," Pinto said.
The Backer family, who have been in the Mendham community for more than 90 years, intends to use a public water system for all brewery operations, with wastewater trucked off-site once a month.
According to Pinto, the Backers have hired a number of professionals to help them maintain the project's integrity. Among the professionals hired were a civil engineer, a land use planner, a professional wetlands scientist, and a farmland preservation expert.
Resident Bob Fox argued that despite the township's allowances for waivers from municipal regulations, one topic that was left out was the safety concerns caused by increased traffic.
"The absence of the matter of public safety concerning the increase of traffic on the road and through two of the most hazardous intersections in the township was not even mentioned in the attorney's response," Fox said.
In his comment, Fox alleged that the addition of the brewery would increase the number of vehicles in the area by nearly 300%. "The proposed brewery would have a major impact on safety at two dangerous intersections."
In response, Pinto stated that a traffic engineer had been hired by the Backer family to review any and all impacts on the local roadways.
Resident George Koenig stated that the project should have to go through the township's environmental commission. "I understand the jurisdiction is with the agriculture board, but I don't think that skirts your abilities or responsibility to give input on Mendham Township land that's being developed."

The Mendham Township Zoning Board of Adjustment voted 5-2 in favor of the Backer Farm project last February, stating that the development was permissible under the township's agriculture ordinance.
Following zoning approval, Backer Farm will hold a public hearing in front of the Morris County Agricultural Development Board to have its site-specific agricultural management practice application heard.
The Morris County Agriculture Development Board scheduled a virtual hearing on the farm's proposal for a brewery and tasting room on Aug. 11 after months of waiting, but it was canceled.
According to Pinto, the cancellation was caused by the township's engineer changing his mind about whether the project qualified as a major stormwater development. According to Pinto, the change in opinion occurred on Aug. 10, prompting the county to cancel the public hearing.
While residents were pleased to hear a representative of the brewery project clarify some issues, a couple of them stated that they needed even more transparency before feeling at ease.
"I would love to sit down with the Backers and get a few neighbors together with them. Let's sit down and chat, let's see if we can walk through it. Tell us really what you're thinking and we will tell you what we're really thinking. We don't have to argue this out in court, this thing will go for years at this pace. I think there might be a possibility of a solution, where they can have a nice, quiet, economically viable community brewery that we can all be very proud of," Koenig said.

MENDHAM, NJ — As work on the municipal budget for 2023-24 continues in Mendham Township, the finance committee anticipates another year with no tax increases.
The Mendham Township Committee met on Monday, April 10 for a regular committee meeting, where they heard the latest update on the budget.
Jason Gabloff, the Chief Financial Officer for Mendham Township provided the update and set up the timeline for the official budget introduction.
The public will be able to hear a more detailed discussion of the overall budget on May 8, with the final public hearing and adoption scheduled for June 12.
According to Gabloff, the finance committee was successful in maintaining the total amount to be raised by taxes at the same level as it was the previous year, a feat that was lauded by a number of committee members.
Additionally, the township's net valuations increased by about $70 million from the previous year. Together, these two factors have made it possible for the township to reduce its tax rate for 2023. The tax rate has decreased from .417 in 2022 to .404.
In Mendham Township, the average home value sits at $948,400, according to projections from the finance committee. Using that calculation, the average homeowner would have a tax bill of $3,826.86, which is a decrease of $127.97.
The municipal property tax, however, is just about 20 percent of a property tax bill, with the bulk of that coming from taxes from the grades 9-12 West Morris Regional High School and K-8 local school district.
Gabloff stated that the township will spend approximately $2.8 million on road projects, which have already begun and include Department of Transportation projects on East and West Main Street. Equipment and improvements make up an additional $1.1 million of the capital spending plan.
"It's pretty impressive that despite multiple unfunded mandates from the state of New Jersey and the regulations and health benefits costs, we were able to do something that most towns can't even do in a regular budget year. I think this will be the fourth year of no increases in taxes, and that is super impressive," Deputy Mayor Sarah Neibart said.
This spending plan is only an update on the official budget plan. A formal introduction will be held on May 8, with a public hearing and final vote have been scheduled for June 12.

For the second year, the Mendhams Stigma-Free Task Force is commemorating May as Mental Health Awareness Month by hosting its second annual "Stomp Out the Stigma Walk." The walk is scheduled for Sunday, May 7, and will begin between 1 and 1:30 p.m. in the parking lot of Grace Lutheran Church.
The goal of the walk this year is to raise money for college scholarships for Mendham High School graduates who are considering careers in the fields of mental health and substance use disorders more broadly.
Additionally, funds will be used to support grants to local organizations as well as ongoing activities, workshops, and educational events for parents, teens and seniors.
"The whole idea is to raise awareness about mental health issues and substance abuse disorders. May is mental health awareness month and so we are hoping to get a good turnout, like we did last year," said Amalia Duarte, Mendham Township Committeewoman.
The 2022 walk raised funds to purchase two People's Picnic Tables for installation in Mendham Township and Mendham Borough parks.
Task Force members also painted those two tables in a bright, bold "Optimistic Yellow," with the goal of using these eye-catching tables to raise mental health awareness and provide a space for connection. The two tables also have plaques with their mission statement and a QR code that will take anyone in need of more information and resources.
The tables were part of a larger Morris County-wide project coordinated by the Mental Health Association of Essex and Morris (MHA) and Team Destig.

MENDHAM, NJ — As budget work for the Mendham Township School District continues, preliminary projections show a decrease in school taxes for Mendham residents.
Superintendent Dr. Sal Constantino, Business Administrator Donna Mosner, and members of the Board of Education will be presenting the proposed budget at two public budget hearings, which are scheduled for April 13.
The public is invited to the two open houses, which are planned for 9 a.m. and 6 p.m. at Mendham Township Elementary School, 18 W. Main Street.
"We hope to see all township residents at the budget open houses," Constantino said. "This is an opportunity for us to hear value feedback from the community and for the community to learn how the budget process supports the type of educational programs that make Mendham Township’s schools stand out."
The district is proposing a budget of $22.36 million for the 2023-24 school year, which will fund the expansion of instructional programs that align with the district's commitment to providing quality education to all students.
Even in the face of rising costs and increased student enrollment, the district's administration and board of education touted fiscal responsibility while prioritizing educational programming and student learning outcomes.
Because of the district's multi-year budget planning, the Mendham Township School District has a banked cap that will expire if not used within the next two to three years.
As a result, the Mendham Township School District will use the banked cap to raise the tax levy by 4.29 percent. This is $394,807 more than the limit, officials said.
Residents will, however, see a reduction in the school portion of their tax bills for two reasons. First, the township underwent a revaluation in 2022, which resulted in a $168 million increase in total ratables.
Second, the bond referendum approved by voters in 2022 provided the district with even more state aid than the $1.27 million granted by the state for the regular operating budget. "In fact, the state committed to pay $7.4 million of the $19.9 million toward those specific voter-approved projects over the life of the bonds," the district said.
A home assessed at Mendham Township's average, which is $948,400, can expect a $363.44 tax reduction over the course of a year. Another way to consider the tax impact is that for every $100,000 of assessed home value, a resident can expect a $35.86 per year decrease.
Following these budget presentations, the district will monitor conditions and consider community feedback before the board formally votes on the budget on April 25 at 7:30 p.m. at Mendham Township Elementary School.

According to Mendham Township Parks and Recreation Director David Guida, the proposal to upgrade certain areas of Wysong Park was brought forth to the recreation committee by two parents involved with the baseball and softball leagues.
The proposal calls for a four-foot-high chain-link border fence to be built around the existing baseball field. This addition would improve park safety by creating a physical barrier between the baseball field and the nearby playground. It would also protect spectators in the park during a game.
According to Joseph Lynch, one of the coaches presenting the proposal, children have a habit of walking onto the field while games are in progress, unaware that they are entering an active game space.
Last year, a child was hit in the face with a fly ball after walking into the game area.
"Luckily, he didn't break anything… But it's only a matter of time before someone gets seriously injured off that," Lynch said.
Another improvement would be the installation of chain-link dugout enclosures, which are currently not present at Wysong.
According to Lynch, some of the recreational baseball games take place in the late summer months, which means that kids are sitting in the hot sun with no shade.
"You're having eight-year-old, seven-year-old, six-year-old kids playing six hours in the sun. We've been bringing in tenting and fans just to kind of keep them cooled down, but I mean this would go a long way and prevent kids from getting heat stroke and even just basic overheating," Lynch said.
Unlike previous recreation proposals, this one would be entirely self-funded, Lynch said.
The total cost is anticipated to be between $17,000- $18,000 and would be made up of fundraising contributions, which have already been organized.
"Wysong is in need of upgrades. I think a lot of the fields, which is why this is becoming an issue across all three towns, Chester, the township and the borough. They need to be upgraded... We could use some improvement in most of our fields," Lynch said.
Committeewoman Lauren Spirig praised the effort, calling it an incredible investment in the children of Mendham and a great display of dedication from the community's local recreation teams.
"I see how much time you guys spend, and it's all just for the love of the game and the kids, and this is just the next level for that. You are really doing an amazing thing for our kids and I see no downside. You are doing a great service to our town," Spirig said.
