The water coming from one of Miramar’s two water treatment plants is not being treated properly and is causing major damage to copper pipes used by thousands of residents and businesses, according to a lawsuit filed in Broward on Wednesday.
The lawsuit, which seeks class-action status, names eight plaintiffs who say their copper pipes have “developed pitting or pinholes and must be replaced.” The cuplrit, they say, is the city’s West Water Treatment Plant, which, according to the lawsuit, removes certain minerals from water but fails to replace it, leaving copper pipes vulnerable to corrosion.
The issue concerns the effect of water on pipes, according to the plaintiffs’ lawyer. The water in Miramar is safe for cooking, bathing, washing and drinking, and there’s no allegation being made to suggest otherwise.
The city manager’s office responded about Wednesday’s lawsuit by saying it “is similar to the subordination lawsuits filed in 2019. Those cases were dismissed with prejudice.”
The Broward circuit judge at the time ruled he was bound by a 1985 court decision in Clearwater that said “a municipality, as a provider of water services, does not have a duty to provide water which will not corrode its customers’ pipes.”
The city has previously acknowledged the issue but has denied blame. In 2018 Miramar hired an engineering consulting company, Kimley-Horn, to review the West Water Treatment Plant’s procedures and the water quality. The lawsuit accuses the city of failing to adopt Kinley-Horn’s recommendations to add corrosion control to the treatment process.
Three years later, Kinley-Horn was again asked to review the water quality. “Based on the historical water quality and sampling information provided, there is no indication that the finished water quality from the city’s [water treatment plants] have contributed to accelerated corrosion,” according to the Kimley-Horn findings posted on the city’s website.
Something else is likely to blame for the corrosion problems, the study concluded.
The West Water Treatment Plant serves city residents and businesses between Palm Avenue and Southwest 196th Avenue.
The city has been offering $10,000 loans to homeowners at a 1% interest rate, giving homeowners five years to pay it back.
That’s not good enough, say homeowners.
“My wife and I were shocked to hear that the cost of this repair could be upwards of $20,000,” said Enrique Antezana, one of the plaintiffs. “Buying our home was a serious investment, and this was supposed to be a happy time in our lives! It was disheartening to know that we would be paying so much for a repair on our first house right away.”
Plaintiffs’ attorney Leslie Kroeger, a partner with Cohen Milstein Sellers & Toll, warned that the severity of the issue will only become clear when more leaks are discovered in more homes. She anticipates hundreds of homeowners, maybe thousands, will be directly affected.
“It really depends on how many have copper plumbing and when the leaks will be discovered,” Kroeger said.

Louisville, Kentucky-based Humana moved out of the entire 96,000-square-foot Miramar Centre II building at 3501 S.W. 160th Ave. even though its lease was through June of this year, said Mike Nathanson, Miramar Centre II's director of leasing. The space is being marketed for $24 per square foot, not including maintenance and utility fees and taxes, Nathanson added.
The move out of Miramar Centre II is part of the company's overall pivot toward hybrid working where employees work from home at least part of the year, said Nancy A. Hanewinckel, a spokeswoman for Humana (NYSE: HUM).
"Like most companies today, Humana has evolved to offer more flexible work styles while still meeting the needs of our business," Hanewinckel said. "This has resulted in reduced office space needs and a decline in our overall real estate footprint."
Humana will remain in the approximately 30,000 square feet the corporation leases in Miramar Centre I at 3401 S.W. 160th Ave., she added.
Miramar Centre II was among a portfolio of 53 office properties across the U.S. that was purchased for $1.1 billion by Boca Raton-based Workspace Property Trust in August 2022.
South Florida's office market has been generally strong, though some companies have scaled back space they occupy. Boca Raton-based security company ADT (NYSE: ADT), for example, will shrink its office footprint at 1501 Yamato Road from 173,490 square feet to 102,610 square feet.

In March 2020, a fintech company paid $29 million for a four-story office building in Miramar that it intended to occupy as its main headquarters. Now Fort Lauderdale-based BHG Financial plans to lease out the entire building at 3700 Lakeside Drive to other tenants.
BHG Financial changed its plans during the course of the pandemic as more of its employees worked from home, said Meredith Crawford, BHG's senior vice president of community outreach and public relations.
"At the time, we adopted a remote environment to prioritize the health and safety of our employee base. Since then, the landscape has continued to evolve, and BHG has been agile in responding to how our employees prefer to work while maintaining the most efficient productivity," Crawford said.
Founded in 2001, the company formerly known as Bankers Healthcare Group opened its headquarters in an office building in Davie in 2015. Five years later, BHG closed on a deal to purchase the 3700 Lakeside building from David Berger and Ezra Katz with the intent on making the office its new HQ.
BHG later opted to move its headquarters into a 10,000-square-foot space in The Main Las Olas, a Class A office building in downtown Fort Lauderdale for use as a collaborative space for its hybrid workforce. Today, the firm, which provides personal and small business loans, employs 530 people in Florida and more than 1,000 people across the U.S. "In total 90% of BHG employees nationwide choose to work remotely," Crawford said.
South Florida's office market has generally prospered as more companies relocate to the area, although office transactions has slowed due to higher interest rates. Not helping is a general skepticism among banks to finance office deals due to remote working trends across the U.S.
In Miramar, demand for office space remains relatively strong in general, but mainly for flex office product in industrial buildings, said Jonathan Kingsley, a vice chairman at Colliers. Broward's office market in general has been dominated by smaller office deals. "The market for large tenants in Broward County, particularly in the suburbs, has dried up completely," he said.
The 3700 building, built in 1996 and renovated in 1998, is about 145,755 square feet in size, according to property research website Reonomy. About 132,000 square feet of office is available for lease at $25 per square foot, not including maintenance, taxes, and utilities, said Christina Stine Jolley, senior vice president of Blanca Commercial Real Estate.

Miramar, FL –ON YOUR FEET! the Broadway Musical comes to the Miramar Cultural Center (MCC), 2400 Civic Center Place, Miramar, FL 33025 on Friday, March 10th and Saturday, March 11th, 2023, at 8pm.
Tickets start at just $35 and are available at MiramarCulturalCenter.org or via the MCC Box Office, which is open Tuesday through Friday, 12pm to 5pm and 2 hours prior to showtime.
ON YOUR FEET! is the exhilarating original musical based on the extraordinary life of 26-time Grammy Award-winning husband-and-wife team, Gloria and Emilio Estefan. The score made up of some of the most loved and iconic songs of the past quarter-century including “Rhythm is Gonna Get You,” “Conga,” “Get On Your Feet,” “Don’t Want To Lose You Now,” “1-2-3” and “Coming Out of the Dark.”

ON YOUR FEET! made its Broadway debut in November 2015 and received seven Outer Critics Circle Award nominations, three Drama League Award nominations and a Tony Award® nomination for Best Choreography.
In this exciting production directed and choreographed by Luis Salgado, Salgado adds, “I could never express my gratitude for the level of representation in this tour, showing what an American truly looks like. Our leads are from Mexico and Venezuela, our music director is from Colombia, and I am from Puerto Rico. The representation is so powerful, real, and honest to the story we are telling. It will resonate into an explosive experience for everyone who comes to see the show.”
