County’s ‘black cloud’: Mostly vacant mall subject of much frustration

“It’s a black cloud over the county,” said Boyd County Judge-Executive Eric Chaney. “It’s dying for a change of ownership. It’s dying for a change of direction.”

When Cedar Knoll Galleria first hit the scene in 1989, its popularity launched like a rocket. A suitable spot for food-court dining options and retailers — both of big and small stature — Cedar Knoll was booming with business throughout its sprawling space up through the mid-1990s.

The late 1990s and early 2000s weren’t as kind to Cedar Knoll, which became Kyova Mall in 2005 under new owner Eggleston Associates. The Cincinnati-based company has owned the mall for the last 15 years, but Chaney and T.J. Morrison, Director of Community & Economic Development, are eager for Eggleston to exit the picture.

“I’ve had two different investment groups (interested), and the second one showed they were willing to make an offer, but it didn’t work out,” Morrison said. “The reception from the ownership group hasn’t been what we want it to be.”

The Daily Independent was unsuccessful in its attempts to reach Eggleston Associates for comment.

The Eggleston era was initially promising. Within the first two years, Steve & Barry’s opened in the old Kmart, and what was formerly Phar-Mor became a perfect fit for Phoenix Theatre, which is now Kyova 10 Theatre.

From 2008 to present day, several stores — Steve & Barry’s, Sears and Elder Beerman prominently among them — closed. A number of businesses either had short stints or couldn’t clear the obstacle of high rent.

“We’ve heard a lot of stories about legitimate businesses that didn’t even get a call back on what rent would be,” Morrison said. “And the rent (when quoted), would be four times what the market standard for rent would be. That kind of stuff is very aggravating.”

Back in the summer, the grass grew to about 3 feet tall and the parking lot had “potholes you can lose a Volkswagen in,” Morrison said.

Morrison said the Eggleston Associates’ Kyova Mall liaison is the company’s attorney and CPA. While Morrison said the county and the representative have a “good relationship,” there hasn’t been much movement in terms of progress.

“We’ve requested meetings to see if there’s a dynamic we’re missing, but it’s never come to fruition,” Morrison said.

“I can’t imagine anyone before us (past administrations) have been more willing to work and find a path forward,” he added.

Reyton Ace Property LLC, which falls under the Eggleston umbrella, is paid up on its property taxes on the mall side of U.S. 60 — it forked over $100,984 this year. However, Reyton Ace is also listed as the owner of 1059 Cedar Knoll Drive, which is the address of Dollar Tree across the street. According to county sheriff records, Reyton Ace hasn’t paid its property tax for that address since 2017, racking up more than $31,000 in delinquent tax bills in that time span.

The latest disappointing chapter for the county was the surprise closure of the Boyd County Clerk’s Office Kyova location this week. Kentucky Power pulled the plug on the portion of the mall within which the clerk’s office falls.

Boyd County Clerk Kevin Johnston said the county is working to find a third location in addition to Catlettsburg and Ashland. It won’t be in the mall.

“We know how important that branch was,” Chaney said. “Its access was great for big vehicles, campers, things like that. We understand the importance of the office. We definitely are going to have another presence in the county.”

Three businesses remain in the cavernous mall.

Rural King operates autonomously and is closed off to the rest of the mall.

Kyova 10 Theatre announced earlier this week it is temporarily closed “until studios begin releasing a steady schedule of new features,” according to its Facebook page. “... This temporary closure will allow our independent theatre to survive in the long-term.”

Callihan’s is open, but not to indoor dining because of Gov. Andy Beshear’s latest COVID-pandemic mandate.

The Boyd County Library had a location at Kyova, but it’s temporarily closed and will ultimately move to a new location under construction on U.S. 60.

Chaney said the mall has “so much potential” because of the heavy traffic flowing in front of it every day.

According to Morrison, around 22,000 vehicles pass by Kyova daily — the second-highest-trafficked area in the county, trailing only the strip of U.S. 23 that runs in between the AK Steel property and Russell Plaza.

“This one is important to us. We’re going to keep pushing,” Morrison said.

“It’s a valuable piece of property in Boyd County,” said Bobby Jack Woods, the county sheriff. “And we need it.”

“The ball’s in their court,” added Chaney, referring to Eggleston. “That mall needs out of current ownership.”

There was only one winning ticket and someone in the Sunshine State matched all six numbers to grab the $235.4 million grand prize, according to the Powerball website. The winner will also have the cash option of $160 million instead.

The winning ticket was sold at the Publix supermarket on North Nebraska Avenue in Lutz, Florida, which is just north of Tampa, according to the Florida lottery. The retailer will receive a $95,000 for selling the ticket.

The winning numbers drawn on Saturday, March 27 were: 6 - 14 - 38 - 39 - 65 and Powerball 6. The Powerplay was 3x.

The jackpot was estimated to be $238 million prior to the drawing, but the jackpot ended up lower based on ticket sales.

Before Saturday night, the jackpot was last won on Jan. 30 by a lottery player who purchased the ticket at a Quick Chek in Cedar Knolls, New Jersey.

Wind farms visible from Ocean County, NJ beaches? Mayors worried

Jersey Shore mayors are sounding the alarm about a proposed expansion of off-shore wind turbines off the coast of Ocean County.

Point Pleasant Beach Mayor Paul Kanitra believes many people may not want to come to the beaches if these wind turbines are just offshore.

"I believe very strongly that having these offshore wind turbines within the visual horizon — which means closer than around 30 nautical miles offshore — would be nothing less than devastating to our tourism economy here in Ocean County," Kanitra said. "I think that the way that this has been moving — the speed that it is moving, the fact that it's been moving behind the scenes and that a lot of very shady deals have been occurring in tandem with it — is something that people really need to wake up to because by the time they see the ships going out there to start building these things, it's going to be way too late."

It's not just the wind turbines that would be in the water that's a concern for Kanitra, but what would happen on the beach itself and with nothing that can be done locally to stop it.

"The state passed a bill in the middle of the night about a year ago that essentially supersedes any kind of local ordinances, local zoning, any policies that pertain to infrastructure or having any control over what would happen in our own town in relation to this — transmission cables coming on shore, infrastructure to help build and maintain these things — the state Legislature said 'we don't care what your town wants and what your town has authorized, we're going to let these companies come in and do whatever they want in your towns' and that was a very, very concerning thing to us," Kanitra said.

Kanitra said there's concern about the optics during the day and at night from these wind turbines and part of the reason why is people want to go to the beach and look at the horizon with unobstructed views.

"If you look out onto the visual horizon, and you see what really is our last pristine natural resource in New Jersey covered with wind turbines and flashing red lights at night, it's nothing short of the industrialization of the ocean," Kanitra said. "We're not anti-clean energy, we're anti ruining our tourist economy in Point Pleasant Beach and in Ocean County."

Tourism is a huge part of the local economies of Monmouth and Ocean counties.

"If these are visible off our beaches, I think that's going to be a detraction," Toms River Mayor Maurice "Mo" Hill said.

While the beach is a big reason why people come to Ocean County in the summer, another reason for tourists and locals to head towards or into the water is to fish and there's concern about this industry as well.

"We do have a substantial commercial fishing industry (in Ocean County) off of Point Pleasant, Barnegat, you've got commercial fisheries. What impact that'll have if they're out using nets and they've got to be mindful that these are jetting up out of the water — it could impact the fishing," Hill said.

"In some cases, as far as sport fishing, it may stimulate that, but will it impact the commercial fishing — that's a concern I think also. I can just imagine if these things are placed the way I'm seeing them being placed — they're going to be close together, so, it's going to be a hazard to navigation out there — it's just another obstacle you're going to have to be careful of."

"We don't have the luxury of just taking huge chunks of those who are coming and supporting our restaurants and businesses and tossing them away for a project like this," Kanitra said.

Another financial concern expressed by some of the Ocean County mayors is the domino effect that wind turbines will have, starting with the tourism economy and its impact on beaches, restaurants, and businesses and then onto taxpayers.

"The economic impact of this is going to be widespread, just a 10% drop in tourism — if that's all that there is as a result of these — that's going to cause real businesses to go out and not come back," Kanitra said. "It's going to hurt my residents because of the jobs that those businesses provide — it's going to have far flung effects across the state and the county that relies on the tax revenue from those businesses and that economic impact."

Lakewood Ranch’s Melodie Marchena remembered being in middle school in Jersey City, New Jersey, and having trouble with math.

Any time her teacher would ask a question, Marchena recalled shrinking in her chair so she wouldn’t be called upon, and her teacher noticed.

Marchena said the way her teacher went out of her way to help made a great impact.

Now as the new owner of Kiddie Academy of Lakewood Ranch, Marchena wants to be a part of those moments that make an impact on her students’ education.

“It’s amazing to see a child grow, develop and learn new things,” Marchena said. “Just like a parent has a huge impact, the teachers have impacts on the children and they take that with them throughout their life.”

After 14 1/2 years, Marina Wolf-Schmidt and her husband, William Schmidt, who are the founders of Kiddie Academy of Lakewood Ranch, decided they wanted to retire.

“We are in our 60s, and we looked at some of our friends and family members who did not make it to retirement due to health issues,” Wolf-Schmidt said. “We said we want to enjoy it. We don’t know what the future holds, and we wanted to start our retirement a little bit earlier than the norm of 65.”

Melodie Marchena and her husband, Sanddy Marchena, officially took over as the new owners May 20.

The Marchenas come from New Jersey where they own Kiddie Academy of Cedar Knolls.

Wolf-Schmidt said the Marchenas' experience eased her worries about leaving.

“They’re going to be such a great match for our school,” Wolf-Schmidt said. “As something we built from the ground up, it’s important for us that we have the right owner. They have the experience. They’re younger than us. They’re going to bring the center to the next level.”

Melodie Marchena looks forward to knowing the families at Kiddie Academy of Lakewood Ranch and learning the needs and desires of the staff.

The Marchenas are considering capital improvements for the school, and that includes a new playground area.

“We look forward to building upon what (Wolf-Schmidt and Schmidt) have already done and continuing to improve the curriculum and the building over time,” Melodie Marchena said.

Wolf-Schmidt said she and her husband will miss being a part of Kiddie Academy of Lakewood Ranch, and they’re grateful for the time they’ve had at the school.

“It’s been such an amazing experience and such a great opportunity to put our center in a community that’s growing,” she said. “It’s just amazing the friendships we’ve established in the community and people trusting us with their children.”

From Kyova to Wow-you-over, a croaking mall is giving way to an economy-boosting, multiple-use complex that could create up to 800 jobs, according to Boyd County Judge-Executive Eric Chaney.

So, what could be coming? A Malibu Jack’s, a farmers market, a 15,000-20,000-capacity sports/concert arena, a 3,000-5,000-person convention center, a 300-room hotel, a 100-unit apartment complex, a bourbon and/or beer distillery, up to eight or nine restaurants and a revamped movie theater. A kayak slip, a fishing area in the Little Sandy River and a walking/jogging trail are factored into the plans, too.

The property is now in the collective hands of Jason and Elisabeth Camp, Glockner Family and the county, as announced on Friday afternoon at the Boyd County Convention and Arts Center — KYOVA has now been rechristened the Camp Landing Entertainment District.

The Camps signed off on the deal Thursday at 2 p.m., purchasing the 92-acre property sitting fallow on U.S. 60 for $8.5 million — $1.1 million higher than the assessed property value listed by the Boyd County Property Value Adminstration website.

Boyd County bought the Sears portion of the mall, a 50-foot breezeway and 2 acres of the parking lot at the former site of R.J. Kahuna’s. Through an $11 million refinanced bond, the $2.5 million went toward purchasing the property, $7.5 million will go toward “things in the mall itself” — $5 million will be applied to the convention center alone.

“The great thing about this bond is it’s going to be at no additional cost to the taxpayer,” Chaney said.

Before the dust settles, the county’s economic development director, T.J. Morrison, said a total of $30 million will be invested into the property by all the parties involved and 800 jobs will be created.

Work on the county-owned portions are to begin Monday, according to Chaney. Camp said within an hour after inking the deal, he already contacted the movie theater manager to see about getting it up and running — right now, Camp said he hopes moving pictures will be shown within three to four weeks.

The hotel on the premise is expected by mid-2023, after contracts are secured. Camp said he’s still reviewing various hoteliers who have approached him and his business partners.

“Right now, there’s a lot of folks who want a part of this, so we’re not jumping on the first offer,” he said. “We want to see what’s out there.”

The timeline on the sports complex is a bit murkier — Morrison said there are interested parties looking into it and designs are being investigated.

“The funding is there,” Morrison said.

Construction costs — which have skyrocketed under recent inflation — shouldn’t slow down the project either, according to Camp. The high cost on materials — which have started to trend downwards — was taken into account, and the idea is to get it timed right to build at a better cost, Camp said.

“The main thing is getting that movie theater reopened,” Camp said. “If we can have something there, we can get restaurants in and start to grow this.”

A deal 16 months in the making started with “Dancing With Our Stars,” when Camp met Chaney and the two began bouncing ideas off of each other in early 2020.

Actually, the idea began blooming before that.

“I got a call. There was this guy, Craig Bouchard,” said Camp in an exclusive interview with The Daily Independent on Wednesday.

Bouchard was the brainchild behind Braidy Industries, which is now Unity Aluminum — a projected $1.8-billion aluminum mill that was to bring about 550 jobs by last year when initially announced. Bouchard has since been ousted by the board of directors, vacated the area, and received a $6 million payout on his way out.

Camp — who, along with his family (wife Elisabeth and five children), relocated from Naples, Florida — stayed put. Camp is part of the Three J’s Group that owns and operates The Winchester and Smokin’ J’s. Originally, the group planned to feed the aluminum mill construction crew at EastPark and then manage an in-house food and beverage service and employee restaurant.

Camp comes from a business and marketing background, mainly in sporting and event management. He said over the better part of two years, he approached the fiscal court about getting a sports complex going. Time and again, Camp said Chaney would brought up the dilapidate mall sitting on U.S. 60.

Through prayer and consultation with his wife, Camp said he came around to the idea of repurposing the old mall, thus planting the seed for the Camp Landing Entertainment District. The Camps will be the majority owner of Camp Landing Entertainment District. Glockner Family is a minority partner.

“I didn’t move up here for money,” Camp said. “I didn’t move up here for business opportunities. I’m a man of a family of faith. Up here is a faith-based community where people ask you how you’re doing or how your day is going, and they want to hear the answer. It’s like, I say that, and I was in Kentucky Farmers Bank for the first time, and I saw a depiction of Jesus and one of the Bible stories, and that’s why I’m here. You couldn’t have that in Naples. You couldn’t have that in Florida. Being a man of faith is looked down on there, but up here, it’s a strength.”

Johnny Eggleston, the late Ron Reynolds and Nancy Reynolds owned Kyova Mall from the mid-2000s until now. The ultimately relinquished control, much to the delight of Chaney and Morrison.

Chaney and Morrison have both called the Kyova Mall a “black cloud” in the county, acknowledging its past successes while labeling its current state.

“Status quo’s been happening in this county for 20 years,” Chaney said. “Let’s switch lanes, let’s switch gears and let’s go. We’re going to hit it, and we’re going to hit it hard.”

“Everything in this country starts with a spark, and what is happening here today (Friday) is that spark,” Chaney said.

The Malibu Jack’s team was present during Friday’s big announcement. They erected their Louisville facility in 80 days. This one could take up to 120. It will be the largest in the state from the Bluegrass-based company, sprawling out over 140,000 square feet.

Malibu Jack’s includes go-karts, miniature golf, bowling, arcade games, laser tag and more. For perspective purposes, the Lexington location is 100,000 square feet.

Both Camp and Morrison said the Malibu Jack’s crew projects this spot to be the No. 1 location in the state, in terms of revenue.

Camp said Malibu Jack’s should be up and running just in time for the holidays.

Commissioners Keith Watts, Larry Brown and Randy Stapleton all emphasized the economic progress this project could bring. Watts said the fiscal court works for the people and they were listening when he received comments from everyday citizens via Facebook about bringing Malibu Jack’s to the area.

“Always reach out to us,” Watts said. “We’re always trying to do what’s best for our community and we’re always listening.”

Brown said he believes this is only the beginning.

“It’s not stopping here, I believe there will only be more opportunities from here,” he said.

Stapleton said the emphasis on economic development was something all the commissioners ran on — and now they’ve delivered.

“When we were elected, we were for economic development,” Stapleton said. “Once we got T.J. on board, I knew we had the right man for the job. This is a big day for Boyd.”

Rural King and Burger King will remain at the current Kyova Mall premises along U.S. 60 near I-64. Camp said Rural King has another four years on its lease and doesn’t anticipate it leaving even after it’s up.

“To my understanding, that’s in the top 15 for sales in the country,” he said. “I don’t think they’ll go anywhere.”

According to Chaney, if all goes as planned, there will be about 250 jobs up for grabs by early 2022.

Chaney, Morrison and Camp also mentioned a few other potential establishments that could land in the district, including golf simulators and axe-throwing.

However, the flip-side to all this is if one component of this district is a flop, or doesn’t come to fruition at all. Camp said he is confident that there are enough entities involved and long-term contracts being worked out that the project as a whole can withstand a failure of one of the parts.

As of Wednesday, the plans potentially included keeping Callihan's American Pub & Grill. However, the owner indicated that it will not remain there. The Kids Sale, another KYOVA fixture, will have one last sale starting July 23.
