WAYNE, NJ – If you’ve been on Pompton Plains Crossroad lately, then you’ve likely seen the rather large mound of dirt set off the road - what Wayne Mayor Chris Vergano recently called, “The largest mountain in New Jersey right now.” He was exaggerating, but a business known as Topsoil Depot has a mound of dirt that looks to be more than 50 feet high. Vergano and Township Attorney Matt Giaccobe spoke briefly about this during this past town council meeting.

“I've received some emails about Topsoil Depot on Pompton Plains Crossroad,” said Vergano. “If you noticed, it's the highest mountain in the state of New Jersey right now, and I say that, unfortunately.”
Vergano mentioned that Pompton Plain Crossroad is often “full of dirt and mud” because of the comings and goings of dirt-laden trucks from the site.
“They are responsible to keep the area clean,” said Vergano. “They do not. I drove by yesterday… it was dirty once again. So, we issued more summonses.”

The township has been in court “multiple times” with “the new owners of the property,” according to Vergano, and have issued them “hundreds of summonses.” In their current litigation, Township Attorney Matt Giaccobe is representing Wayne.
“We’re going to be deposing the owners,” said Giaccobe, “and as long as they're running a topsoil depot…that's not compliant with the long-time settlement agreement.”
In 2012, Topsoil Depot was ordered to remove about 30,000 cubic yards of fill and solid waste and was supposed to have a five-year cleanup plan, but hadn’t done so as of 2013, and only about half was removed by the five-year deadline in 2017, according to previous reporting.

“If you noticed, the mountain is higher than ever,” said Vergano during this past week’s meeting. “Allegedly, they're going to be removing the [inaudible] that's been there for the last 30 years. But I don't see any of that taking place. All I see is a commercial operation where dirt is brought in, sifted and then resold.”
The township is also opposing the owner’s attempts to become a Recycling Facility, which, the mayor said an application for this designation had been filed with the state of New Jersey.
Giacobbe also said that their recycling facility has been crushing concrete, which “is not in compliance.”
“We’re not going to permit that,” he said. “And we did get an injunction on that aspect of it.”
Vergano also mentioned another small victory for the township.
“They were also keeping landscapers’ equipment on the property,” he said. “And once we brought that to their attention, and issued a number of summonses, the landscaping equipment is now removed.”
The courts are a little slow, according to Vergano, but said they are getting better as more judge vacancies are filled.
In the meantime… “We're going to keep holding them accountable and continue issuing them fines,” said Giaccobe. “And we are continuing to monitor all their activities.”
Because this situation is being handled in court, the attorney would say no more.

The approved warehouse will eventually be constructed on Pompton Plain Crossroad at the corner of Farmingdale Avenue. Not far from the Wayne Animal Shelter, and just about across the street from the post office.
March Monello, LLC proposed the changes to a plan that had been approved by the Planning Board in 2018. The recent hearings in front of the Zoning Board were to get approvals for several variances, including the size of the proposed building. The original plan was for a 40,000 sq ft warehouse, but the zoning board’s approval is now allowing for a nearly 70,000 sq ft warehouse.
Local residents were concerned about several issues, including truck traffic, lighting, noise and the idea that this would be a 24-hour operation.
March Monello, LLC is a partnership between March Associates Construction and Monello Landscape Industries – both Wayne companies. They agreed to change several aspects of the site plan to get the needed approval, according to Chris Kok, the Wayne Township Planner.
TAPinto reached out to Joe Monello, who said that their revised site plan had "carefully taken into consideration both the best interests of the residents and the township of Wayne," and that the new warehouse and the surrounding layout "will improve the conditions of the site as it currently exists today."
Kok explained the compromises made in their site plan.
“They agreed to a timeline limitation for when trucks could be maneuvering on site,” he said. “So, between 10:00pm and 5:00am there would be no moving of trucks and that was an idea for protecting neighbors from noise issues.”
Another compromise was that the site itself was redesigned so that there would be no entrance to the warehouse from Farmingdale Road so that all traffic would come and go from the warehouse through the entrance on Pompton Plains Crossroad. And, although the square footage will remain the same, the height of the building was reduced by four feet, mostly through a redesign of the roof. Instead of the roof sloping backward from the front, with rainwater draining to the back, the roof will have a center peak, which "cut the heith of the roof itself in half," according to Kok.
Stormwater retention basins were moved and – at an earlier hearing – March Monello agreed to plant more mature (taller) trees along the back of the property, so that it wouldn’t take as long for them to grow and provide a screen to neighboring residences.
“There’s also going to be a limitation on storing hazardous materials on site,” said Kok, “And they won’t be allowed to park vehicles inside, so it can’t be like a last-mile distribution facility.”
The Planner explained that a last-mile distribution facility is the last stop for packages before they are sent to the final destination, usually a home or a business. “These tend to have higher traffic and trip generation rates,” he said. “That was something the board did not want to see there. So, there is a condition that would prevent that warehouse from being used for that purpose.”
Now that the Zoning Board has approved the warehouse, the next step is to have the approval memorialized in an ordinance approved by the town council, then March Monello can submit their building permit – which will need another approval before construction begins.
